As of October 6, 2025, the federal state of Baden-Württemberg has reached its admission quota within the FREE distribution system. As a result, the Stuttgart Immigration Office is instructed to refer applicants to other federal states. Direct admission in Stuttgart therefore currently takes place only in the following exceptional cases:
- A spouse or minor children are already residing in Stuttgart.
- Private accommodation is available. The existence of private housing must be proven by a rental contract valid for at least one year as well as a landlord’s confirmation of residence (Wohnungsgeberbestätigung).
The admission stop remains in place until further notice.
According to information obtained from the Regional Council of Karlsruhe, since October 1, 2025, districts have been permitted to refer individuals to other federal states even if the statewide quota is technically in deficit. As of January 2026, according to oral information provided by the Immigration Office, the City of Stuttgart is currently in a significantly high admission surplus.
We therefore assume that—unlike during the period from April 3, 2025, to May 13, 2025, when a temporary admission stop had already been in place—this trend is likely to continue for some time. It may take a while before the situation balances out and Stuttgart resumes regular admissions.
Based on our experience and observations, this situation also affects the Böblingen district. The Ludwigsburg district and the Rems-Murr district (as of January 2026), however, appear to continue admitting applicants. The State Initial Reception Center (LEA) Karlsruhe also continues to receive individuals and is currently distributing them within Baden-Württemberg, including to the districts of Tübingen, Reutlingen, and Esslingen.
Mit Erreichen eines stabilen positiven Erfüllungsstandes bei der landesweiten Aufnahme ukrainischer Geflüchteter in FREE wurde allen unteren Ausländerbehörden mit Schreiben vom 1. Oktober 2025, Az. JUMRV-1300-83/32/34 die Möglichkeit eröffnet, neu ankommende Ukrainer in andere Länder mit einem Aufnahmedefizit weiterzuleiten. Dies umfasst neben den aus der Erstaufnahme verteilten Personen auch die vor Ort direkt ankommenden Geflüchteten aus der Ukraine. Bei Weiterleitungen durch die Erstaufnahme haben die Erfahrungen gezeigt, dass – bedingt durch die hohe Anzahl an Zugängen – ein Aufnahmeplus von mehreren hundert Personen bereits nach wenigen Tagen abgeschmolzen war. Im Ergebnis hatten die unteren Ausländerbehörden zeitlich damit kaum eine Gelegenheit, die bei ihnen vorstellig werdenden Direktankünfte über FREE (ebenfalls) weiterzuleiten, sodass diese stets in der Zuständigkeit der unteren Aufnahme- und unteren Ausländerbehörde verblieben sind. Bei Vorliegen der Voraussetzungen für einen Verbleib in Baden-Württemberg (z.B. Kernfamilie, Wohnraum) kann auch von einer Weiteroptionierung in andere Bundesländer abgesehen werden.
